Privacy, terms & refunds.

This document is published by Futz Games (“Futz Games,” “we,” “us,” or “our”) and governs your use of all mobile applications, games, websites, and related services we develop, publish, or operate (each, an “App,” and collectively, the “Services”). It applies to every current and future Futz Games title unless a specific App publishes its own policy that expressly supersedes this one.

In plain language. We make casual mobile games. To run them, we and trusted partners (ad networks, analytics providers, the app stores) may process limited information — device and advertising identifiers, usage and gameplay data, approximate region, crash data, and purchase records. We may show advertising, offer in-app purchases and subscriptions, and use analytics. We do not sell your identity. You have rights over your data. This summary does not replace the full text below.

1. Scope & who we are

Futz Games develops and publishes casual mobile games distributed through platforms including the Google Play Store and the Apple App Store. This policy covers all of our Apps and Services on every platform, present and future. By downloading, installing, accessing, or using any Service, you acknowledge that you have read and understood this document. If you do not agree, do not use the Services.

For the purposes of the EU General Data Protection Regulation (“GDPR”) and the UK GDPR, Futz Games is the “data controller” for personal data processed through the Services, except where a third-party service named below acts as an independent controller of data it collects directly.

2. Information we collect

The specific data processed varies by App and by the features you use. Across our Services we may collect or process the following categories, now or in the future:

2.1 Information you provide

  • Information you submit when contacting support (e.g., your email address and message contents).
  • User-generated content such as a display name, avatar selection, or in-game preferences, where an App offers them.
  • Account information, if an App offers optional account creation or sign-in (including via third-party login providers).

2.2 Information collected automatically

  • Device information: device model, manufacturer, operating system and version, language, time zone, screen and hardware characteristics, and system settings.
  • Identifiers: advertising identifiers (Google Advertising ID / Apple IDFA where permitted), app-set/app-instance identifiers, and similar pseudonymous identifiers.
  • Usage & gameplay data: levels played, progress, scores, sessions, feature interactions, in-app events, and settings.
  • Approximate location: coarse/region-level location inferred from IP address (we do not collect precise GPS location unless a specific App explicitly requests it with your consent).
  • Technical & diagnostic data: IP address, crash logs, error reports, performance metrics, and network type.
  • Advertising & measurement data: ad impressions, clicks, and related interaction data processed by our advertising partners.

2.3 Information from purchases and subscriptions

  • Records of in-app purchases, subscriptions, entitlements, transaction identifiers, purchase tokens, and subscription status.
  • We do not collect or store your full payment card number or bank details — all payments are processed by the app stores (Google Play Billing, Apple In-App Purchase) or their payment processors. We receive only confirmation and transaction metadata necessary to deliver and validate your purchase.

3. How we collect it

  • Directly from your device as you use the Services.
  • Automatically through software development kits (SDKs), APIs, and libraries integrated into our Apps (e.g., advertising, analytics, and crash-reporting tools).
  • From the app stores and platform providers in connection with downloads, purchases, and subscriptions.
  • From third-party partners that provide advertising, attribution, or measurement services.

4. How we use information

  • To provide, operate, maintain, and improve the Services and game functionality.
  • To save and synchronize game progress, settings, and entitlements.
  • To deliver, personalize, measure, and optimize advertising (subject to your consent where required).
  • To process and validate in-app purchases and manage subscriptions, including renewals, entitlements, and restoration of purchases.
  • To analyze usage, diagnose crashes, monitor performance, and develop new features and titles.
  • To detect, prevent, and address fraud, abuse, security incidents, and technical issues.
  • To respond to your support requests and communicate with you about the Services.
  • To comply with legal obligations and enforce our terms.

6. Advertising & identifiers

Some Apps are supported by advertising. We may display banner, interstitial, rewarded, native, app-open, and other ad formats through third-party ad networks and mediation platforms, which may include Google AdMob, Google Ad Manager, Unity Ads, AppLovin, ironSource / Unity LevelPlay, Meta Audience Network, and similar providers.

These partners may collect and use advertising identifiers and related data to deliver and measure advertising, including personalized (interest-based) advertising where you have consented. In regions that require it (such as the EEA, UK, and Switzerland), we present a consent mechanism (e.g., a Consent Management Platform compliant with the IAB Transparency & Consent Framework and Google’s consent requirements) before personalized ads are served. Where consent is not given, we aim to serve only non-personalized or contextual advertising.

You can limit ad tracking at any time through your device settings (“Reset/Delete Advertising ID,” “Limit Ad Tracking,” or App Tracking Transparency on iOS). Our app-ads.txt file, published at the root of this domain, authorizes our advertising sellers in accordance with the IAB Tech Lab standard.

7. Analytics & crash reporting

We use analytics and crash-reporting tools to understand how our Apps are used and to fix problems. These may include Google Analytics for Firebase, Firebase Crashlytics, Unity Analytics, and similar services. These tools process pseudonymous usage and diagnostic data, which we use in aggregate to improve gameplay, stability, and design.

8. Purchases, subscriptions & billing

Our Apps may offer one-time in-app purchases (e.g., to remove ads, unlock content, or obtain virtual items) and recurring subscriptions that provide ongoing benefits.

  • Processing. All transactions are handled by the platform’s billing system (Google Play Billing or Apple In-App Purchase). Your payment method is managed by the platform and your Google or Apple account, not by Futz Games.
  • Subscriptions. Subscriptions automatically renew for the selected period (e.g., weekly, monthly, or yearly) unless cancelled at least 24 hours before the end of the current period. Your account is charged within 24 hours prior to the end of the current period at the then-current price. Free trials, if offered, automatically convert to a paid subscription unless cancelled before the trial ends; any unused portion of a free trial is forfeited upon purchase of a subscription.
  • Managing & cancelling. You can view, manage, or cancel subscriptions at any time in your Google Play account settings or your Apple ID subscription settings. Cancellation stops future renewals; it does not retroactively refund the current period.
  • Virtual items. Virtual items, currencies, and unlocks have no real-world monetary value, are licensed (not sold) to you, are non-transferable, and may be modified or discontinued. They cannot be exchanged for cash except where required by law.
  • Restoring purchases. Non-consumable purchases and active subscriptions can generally be restored on a new device using the same store account.

9. Refund policy

All sales are final. Except where a refund is required by applicable law or granted at the sole discretion of the relevant app store, Futz Games does not provide refunds for any in-app purchase, subscription, virtual item, or other paid content.

  • Because purchases are processed entirely by Google Play or the Apple App Store, Futz Games does not have the technical ability to issue direct refunds. All refund requests must be directed to the applicable app store and are subject to that store’s policies.
  • Google Play refund requests are handled through your Google Play account or Google Play support. Apple refund requests are handled through reportaproblem.apple.com.
  • Cancelling a subscription prevents future charges but does not entitle you to a refund for the current or prior billing periods, except where required by law.
  • Virtual items and consumables that have been delivered are non-refundable.
  • Statutory rights. Nothing in this policy limits any non-waivable rights you have under mandatory consumer-protection laws in your jurisdiction (for example, certain withdrawal/refund rights in the EU/UK). Where such rights apply, they prevail over this section to the extent of any conflict.

10. Third-party services & SDKs

Our Apps may integrate third-party services that process data under their own privacy policies, as independent or joint controllers. Depending on the App, these may include, without limitation:

The presence of a provider in this list does not mean it is used in every App. We encourage you to review these third parties’ policies.

11. How we share information

We do not sell your personal information in the conventional sense (i.e., for monetary consideration in exchange for identifying you personally). We may share information:

  • With service providers and SDK partners (advertising, analytics, hosting, crash reporting) acting on our behalf or as independent controllers of data they collect.
  • With the app stores and platform providers to deliver, validate, and support the Services and transactions.
  • To comply with law, legal process, or enforceable governmental requests; to enforce our terms; or to protect the rights, property, or safety of Futz Games, our users, or the public.
  • In connection with a merger, acquisition, financing, reorganization, or sale of assets, in which case data may be transferred as part of the transaction subject to this policy.

Certain data sharing for advertising may be considered a “sale” or “sharing” under some US state laws. See US state rights below for your opt-out options.

12. International data transfers

We and our partners may process and store information in countries other than the one in which you reside, including the United States and other jurisdictions that may not provide the same level of data protection as your home country. Where required, we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses for such transfers.

13. Data retention

We retain information only for as long as necessary to fulfill the purposes described in this policy, including providing the Services, complying with legal obligations, resolving disputes, and enforcing agreements. Pseudonymous analytics and advertising data are typically retained for a limited period in line with our partners’ standard retention windows, after which they are deleted or aggregated. Purchase and tax records may be retained as required by law.

14. Security

We implement reasonable technical and organizational measures designed to protect information against unauthorized access, loss, misuse, or alteration. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You use the Services at your own risk.

15. Children’s privacy

Our Services are not directed to children under the age of 13 (or the minimum age required in your jurisdiction, such as 16 in parts of the EEA), and we do not knowingly collect personal information from children in violation of applicable law. Where an App is directed to or likely to be used by children, we configure advertising and analytics partners to treat such users in a child-appropriate manner (for example, by enabling “tag for child-directed treatment” / “tag for users under the age of consent,” disabling personalized ads, and limiting data collection) in accordance with the U.S. Children’s Online Privacy Protection Act (COPPA), the Google Play Families policy, and similar frameworks.

If you believe a child has provided us with personal information without appropriate consent, please contact us and we will take reasonable steps to delete it.

16. Your rights & choices

  • Advertising: reset or delete your advertising identifier, or enable “Limit Ad Tracking” / decline App Tracking Transparency, via device settings.
  • Permissions: manage app permissions (e.g., notifications) in your device settings.
  • Consent: where we present a consent dialog, you can change your choices via the in-app privacy/consent settings where available.
  • Access, correction, deletion: you may request access to, correction of, or deletion of your personal data, subject to legal limits (see Contact).

17. European users (GDPR / UK GDPR)

If you are in the EEA, UK, or Switzerland, you have the rights to: access your personal data; rectify inaccurate data; erase data (“right to be forgotten”); restrict or object to processing; data portability; and withdraw consent at any time. You also have the right to lodge a complaint with your local data protection authority. To exercise these rights, contact us using the details below. We will respond within the timeframes required by law.

18. California & other US state privacy rights

If you are a California resident, the California Consumer Privacy Act (as amended by the CPRA) provides rights to know, access, delete, and correct personal information, and to opt out of the “sale” or “sharing” of personal information for cross-context behavioral advertising, without discrimination. Similar rights may apply under the laws of other US states (e.g., Virginia, Colorado, Connecticut, Utah, Texas). To opt out of personalized advertising, use your device’s advertising controls and any in-app consent settings, or contact us. We do not knowingly sell the personal information of consumers under 16 years of age.

19. Terms of service

These Terms of Service (“Terms”) govern your use of the Services together with the privacy provisions above. By using any Service you agree to these Terms. If you do not agree, do not use the Services. You must be of the minimum legal age in your jurisdiction (or have verifiable parental/guardian consent) to use the Services.

20. License & acceptable use

Subject to these Terms, Futz Games grants you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Apps for your own non-commercial entertainment on devices you own or control. You agree not to:

  • copy, modify, reverse engineer, decompile, or create derivative works from the Apps except as permitted by law;
  • cheat, exploit, use unauthorized third-party software, or interfere with the integrity or security of the Services;
  • use the Services for any unlawful purpose or in violation of any applicable law or app-store policy;
  • resell, sublicense, or commercially exploit the Services or any virtual items.

We may suspend or terminate your access to the Services at any time for violation of these Terms or applicable policies.

21. Intellectual property

The Services, including all software, graphics, audio, characters, designs, trademarks, and content, are owned by Futz Games or its licensors and are protected by intellectual property laws. Except for the limited license granted above, no rights are transferred to you. Third-party assets are used under their respective licenses.

22. Disclaimers & limitation of liability

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. To the maximum extent permitted by applicable law, Futz Games shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the Services. Our aggregate liability for any claim relating to the Services shall not exceed the greater of the amount you paid us for the relevant Service in the twelve months preceding the claim, or USD 10. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing limits liability that cannot be excluded by law.

23. Changes to this document

We may update this document from time to time to reflect changes in our practices, technology, legal requirements, or the addition of new features (such as new monetization, advertising, or social features). When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice within the Services. Your continued use of the Services after changes take effect constitutes acceptance of the updated document.
